The question below was submitted by Sara Van LeeWuen of the Physicians Partner Group in Indianapolis. Our thanks to Steve Richey, a partner with Thompson Hine for this response.

I was looking at the article on record keeping and wondered if you had any specific information regarding the necessity of keeping timesheets that were signed by the employee on file or if electronic records were acceptable. I attended a wage and hour law seminar in 2004 and at that time they were teaching that a signed hard copy of the timesheet had to be kept on file and electronic records could not be used. I have been looking for any documentation that might support allowing us to use the submit and approve functions of Novatime rather than print and keep the hard copies. I also wondered if these had to be kept for Exempt employees at all since the article here was specific to non exempt employees.

This next question was submitted by Linda Nixon from UC. For a response we went to Bob Wirth, our corporate accountant. Bob is a CPA and President of Wirth, Lowe and Wissemeier.

We have a physician who was employed here for several years. He recently accepted a position in Riyadh, Saudi Arabia. However, he is still providing services to us via phone, conference via computer cam, etc. If we continue to consider him as an employee, what taxes should we access?
